흑인과 백인간의 인종차별이 만연했던 1950년대와 60년대에 마틴 루터 킹 박사를 중심으로 시민권 운동이 대대적으로 펼쳐지면서, 결국 제도적으로는 흑백간의 인종차별이 사라졌습니다만, 이보다 약 20년 앞서 미국 캘리포니아주에서는 백인과 멕시코계 이민자에 대한 인종 차별을 없애기 위한 중요한 일이 벌어졌습니다.
1944년, 멕시코계 미국인의 딸인 실비아가 미국 공립학교인 웨스트민스터 초등학교에 입학하려고 했으나 멕시코계라는 이유로 입학을 거부당하고, 멕시칸들을 위해 설립된 학교로 보내졌습니다. 실비아의 아빠는 자신의 가족들 모두 정당한 미국 시민권을 갖고 있음에도 실비아가 인종차별을 받는 것에 대해 부당함을 느끼고 이를 바로 잡기 위한 노력을 시작했습니다. 처음에는 학교 교장과 교육청의 장학관에게 찾아가 항의했습니다만, 이들은 뚜렸한 이유도 대지 못하면서 규칙이 그렇기 때문에 어쩔 수 없다는 말만 되풀이 했습니다.
백인들이 다니는 학교와 비교해 멕시칸계 학교는 인력이나 시설이 너무 낙후되어 있었고, 심지어 운동장이나 식당 시설조차도 없어서 파리가 들끓는 흙바닥에 앉아서 도시락을 먹어야 했습니다.
수년간의 노력에도 전혀 개선될 기미가 보이지 않자, 실비아의 아빠는 소송을 제기했습니다. 미국 LA지방법원에서 벌어진 재판에서 백인학교를 대표하는 장학관과 멕시코계 이민자 가족들 간에 치열한 법종동방이 펼쳐지고, 결국 실비아 가족은 승소를 하게 됩니다. 그리고 항소법원에서의 재판결과도 실비아 가족의 승리로 끝나게 되자, 캘리포니아 주지사는 모든 학교에서 인종, 출신지, 언어에 따른 차별을 금지하는 법을 서명하였습니다.
실비아 가족의 3년에 걸친 치열한 투쟁의 결과로 학교에서의 부당한 인종차별이 사라지게 되었으며, 실비아는 처음에 원했던 웨스트민스터 초등학교에 입학해서 많은 백인 친구들을 사귀면서 아무 탈 없이 학교를 다녔습니다. 그리고 수천명의 멕시코계 아이들도 차별없이 공립학교에 다닐 수 있게 되었지요.

Pura Belpe Award winning Tonatiuh (Pancho Rabbit and the Coyote, 2013) makes excellent use of picture-book storytelling to bring attention to the 1947 California ruling against public-school segregation. The concise, informative text, with occasional and always translated Spanish lines, discusses how being banned from enrolling in an Orange County grade school because of her skin tone and Mexican surname inspired Sylvia Mendez’ family to fight for integrated schools. Soon they were joined by many others, including the NAACP and the Japanese American Citizens League, which led to their hard-won victory. Tonatiuh’s multimedia artwork showcases period detail, such as the children’s clothing and the differences between the school facilities, in his unique folk art style. An endnote essay recapping the events, photos of Sylvia and her schools, and a glossary and resource list for further research complete this thorough exploration of an event that is rarely taught. This would be a useful complement to other books about the fight for desegregation, such as Deborah Wiles’ Freedom Summer (2001) or Andrea Davis Pinkney’s Sit-In (2010).
